Pivox Terms of Service
The agreement that governs your use of Pivox.
These Terms of Service ("Terms") govern your access to and use of the Pivox budgeting and personal finance platform (the "Service"). By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, you may not use the Service.
1. Eligibility & Accounts
- You must be at least 18 years old and reside in Canada or the United States to register.
- You are responsible for maintaining accurate account information and safeguarding your login credentials.
- Pivox may suspend or terminate accounts that breach these Terms or applicable laws.
You are responsible for providing accurate country, region, and other profile information where requested so Pivox can present the correct financial terminology, disclosures, and service variations.
2. Service Description
- Pivox provides tools for budgeting, transaction tracking, goal planning, and related financial insights.
- Certain content, calculations, suggestions, and disclosures vary by country, state, or province.
- Certain features (for example, Plaid-powered bank connections) rely on third-party services whose availability is outside Pivox’s control.
- We may update, enhance, or discontinue features at any time. Material changes will be communicated through in-app notices or email when feasible.
3. Acceptable Use
Users agree not to:
- Engage in unlawful, fraudulent, or abusive activity while using the Service.
- Attempt to access source code or systems without authorization.
- Upload malicious code or interfere with the security or availability of the Service.
Pivox reserves the right to investigate potential violations and cooperate with law enforcement where required.
4. Paid Services
- The MVP version of Pivox is offered without subscription fees. Future paid plans or add-ons may be introduced with separate terms and pricing.
- Any beta or preview features are provided on an "as-is" basis and may be withdrawn at any time.
If paid plans, consultations, or add-on services are introduced later, additional pricing, billing, cancellation, renewal, or service-specific terms may apply.
5. Third-Party Services
- When connecting financial institutions or other third parties, you authorize Pivox to share necessary data with those partners to deliver the Service.
- Third-party terms (e.g., Plaid, Google) apply in addition to these Terms. Pivox is not responsible for third-party failures or actions.
Some providers may store or process data in a country different from your residence. Pivox will disclose this at a policy level, but provider availability and data handling may differ by institution and jurisdiction.
6. Privacy
Your use of the Service is subject to the Pivox Privacy Policy, which explains how we collect, use, and protect personal information.
7. Data Retention & Export
- Transaction and account data are retained while your account remains active and for up to 30 days after deletion to support legal and backup requirements.
- You may request data exports from the app. Export files remain available for download for 30 days.
- Certain uploaded documents or consultation records may be subject to different retention rules based on law, operational need, or the retention option selected by you where such choice is legally permitted.
8. Disclaimers & Limitation of Liability
- The Service is provided "as is" without warranties of any kind. Pivox disclaims all implied warranties, including merchantability and fitness for a particular purpose.
- Pivox provides informational tools, educational content, and software-assisted insights. Pivox does not guarantee financial outcomes, tax outcomes, insurance outcomes, investment performance, or legal compliance.
- Unless expressly stated otherwise in a separate service agreement, content inside the Service is not individualized professional legal, tax, investment, insurance, or financial advice.
- To the maximum extent permitted by applicable law, Pivox’s total liability for any claim related to the Service is limited to the greater of USD $100, CAD $100, or the amount you paid to Pivox in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless Pivox and its employees from any claims or damages arising from your use of the Service or violation of these Terms.
10. Termination
- You may stop using the Service at any time and may request account deletion through the in-app data & privacy center.
- Pivox may suspend or terminate access if you breach these Terms or if continuing to provide the Service becomes impractical due to law or regulatory changes.
11. Governing Law & Disputes
These Terms are governed by the laws specified in the version of the Terms presented to your account or region, subject to mandatory consumer-protection laws that may apply where you reside. Unless otherwise required by law, disputes will be resolved in the forum identified in the applicable regional Terms notice or in-app legal disclosure.
12. Changes to These Terms
We may update these Terms to reflect operational, legal, or regulatory changes. When we do, we will update the version and effective date above and notify users of material changes. Continued use of the Service constitutes acceptance of the revised Terms.
